App usage for testers May/June 2024

Welcome to BeMyGuest! By accessing or using the mobile app of BeMyGuest through the invitation link we send to the email address you provided, you agree to comply with and be bound by these Terms and Conditions ("Terms"). Please read them carefully. If you do not agree to these Terms, you should not use our App.
 

1. Acceptance of Terms By accessing or using the App, you accept and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you should not use the App.
    

2. Eligibility

   • You must be at least 18 years old to use our App. By using the App, you represent and warrant that you are at least 18 years old and have the right, authority, and capacity to enter into these Terms.

   • The App is intended for users residing in regions where the App is available and legally permitted.
      

3. User Accounts

   • You may be required to create an account to access certain features of the App.

   • You agree to provide accurate, current, and complete information during the registration process.

   • You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

   • You agree to notify us immediately of any unauthorized use of your account.
      

4. User Conduct

   • You agree to use the App only for lawful purposes and in accordance with these Terms.

   • You agree not to use the App to:

     • Violate any applicable laws or regulations.

     • Infringe upon or violate our intellectual property rights or the intellectual property rights of others.

     • Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the App.

     • Upload or transmit any viruses, malware, or other harmful code.

     • Collect or store personal information of other users without their consent.

     • Impersonate or attempt to impersonate BeMyGuest, a BeMyGuest employee, another user, or any other person or entity.
        

5. Content

   • You are responsible for any content you upload, post, or otherwise transmit through the App ("User Content").

   • You grant BeMyGuest a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use, distribute, modify, run, copy, publicly perform or display, translate, and create derivative works of your User Content.

   • BeMyGuest reserves the right to remove or modify User Content for any reason, including if it violates these Terms.
      

6. Intellectual Property

   • All content and materials on the App, including but not limited to text, graphics, logos, and software, are the property of BeMyGuest or its licensors and are protected by copyright, trademark, and other intellectual property laws.

   • You may not use, reproduce, distribute, or create derivative works of any content or materials on the App without our express written permission.
      

7. Privacy

   • Your use of the App is also governed by our Privacy Policy, which is incorporated by reference into these Terms.

   • By using the App, you consent to the collection, use, and sharing of your information as described in our Privacy Policy.
      

8. Third-Party Links and Services

   • The App may contain links to third-party websites or services that are not owned or controlled by BeMyGuest.

   • BeMyGuest has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

   • You acknowledge and agree that BeMyGuest shall not be responsible or liable for any damage or loss caused or alleged to be caused by or in connection with the use of any such content, goods, or services available on or through any such websites or services.
      

9. Termination

   • BeMyGuest may terminate or suspend your account and access to the App at any time, without prior notice or liability, for any reason, including if you breach these Terms.

   • Upon termination, your right to use the App will immediately cease.

   • You can remove your account within the App by navigating to Profile -> Settings -> Delete Account. We will remove all your data from our database. If you are unable to delete your account in the App, please send a 'request to delete my account' to info@bemyguest.community. We aim to support you within 5 working days.
      

10. Limitation of Liability

    • To the fullest extent permitted by applicable law, BeMyGuest shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use of or inability to use the App; (b) any unauthorized access to or use of our servers and/or any personal information stored therein; (c) any interruption or cessation of transmission to or from the App; (d) any bugs, viruses, trojan horses, or the like that may be transmitted to or through the App by any third party; (e) any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the App; and/or (f) the defamatory, offensive, or illegal conduct of any third party.
       

11. Governing Law

    • These Terms shall be governed and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions.
       

12. Changes to Terms

    • We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
